HeroBounce, responsible for this website, hereinafter RESPONSIBLE, makes this document available to users, with which it intends to comply with the obligations set forth in Law 34/2002, of July 11, on Information Society Services and Electronic Commerce (LSSICE), as well as informing all users of the website regarding the conditions of use.

Any person accessing this website assumes the role of user and undertakes to strictly observe and comply with the provisions set forth herein, as well as any other applicable legal provisions. HeroBounce reserves the right to modify any type of information that may appear on the website, without any obligation to notify or inform users, with publication on the herobounce.com website being considered sufficient.

2. Object

Through the Website, we offer Users the opportunity to access our email validation and verification services, including:

  • Email address syntax and format validation
  • Domain verification and MX record checking
  • SMTP server validation
  • Catch-all detection and pattern analysis
  • Disposable email detection
  • API access for automated validations
  • Bulk email list verification
  • Real-time webhook notifications
  • Email Finder — generating and verifying probable professional email addresses from a name and company domain (subject to the DPA in §2A)

2A. Email Finder — Data Processing Agreement

This section constitutes the Data Processing Agreement (DPA) required under Article 28 of the GDPR for use of the Email Finder feature. By accepting this DPA within the product, you enter into a binding agreement with HeroBounce.

§2A.1 Roles and Responsibilities

When you use Email Finder, you act as the Data Controller and HeroBounce acts as the Data Processor under Article 28 GDPR. You are solely responsible for ensuring that your use of Email Finder is lawful, including:

  • Establishing and documenting a valid legal basis (e.g., Legitimate Interest under Article 6(1)(f) GDPR) for B2B prospecting
  • Complying with applicable anti-spam and data protection laws in your jurisdiction
  • Honouring opt-out and erasure requests from data subjects
  • Maintaining records of your processing activities as required by Article 30 GDPR

§2A.2 Nature of Processing by HeroBounce

  • HeroBounce processes first name, last name, and company domain solely to generate and verify probable professional email addresses on your documented instruction
  • Email patterns (e.g. firstname.lastname@domain.com) are derived from publicly observable business email syntax and constitute Business Intelligence, not Personal Data in isolation
  • Generated results are stored in your private account only and deleted automatically after 30 days (Article 5(1)(e) GDPR — storage limitation)
  • HeroBounce does not maintain or sell a static database of personal data; results are generated on demand per your request
  • Sub-processors used: BrightData Ltd (SERP pattern discovery, EU Standard Contractual Clauses in place), Resend Inc (transactional email delivery)

§2A.3 Opt-Out and Data Subject Rights

Individuals may permanently block themselves from all future Email Finder generation attempts via the public opt-out page at herobounce.com/optout. Opt-outs are stored as SHA-256 hashes — plain email addresses are never retained.

For broader GDPR data subject requests (access, portability, erasure), contact support@herobounce.com. HeroBounce will forward requests that relate to Controller-level processing to you within 3 business days.

§2A.4 Acceptable Use

Email Finder may only be used for:

  • Professional B2B outreach where you have documented a Legitimate Interest basis
  • Sales prospecting targeting business contacts in their professional capacity

Email Finder must NOT be used for:

  • Consumer (B2C) targeting or contacting individuals in a personal capacity
  • Harassment, stalking, or any form of unsolicited non-commercial contact
  • Building or enriching databases for resale
  • Any use that would require explicit consent under applicable law

Violation of this acceptable use policy will result in immediate account suspension and may be reported to relevant supervisory authorities.

Governing law for this DPA: Spain (EU). Supervisory authority: Agencia Española de Protección de Datos (AEPD). Full DPA text is accepted within the product dashboard before first use of Email Finder.

3. Service Terms and Usage

3.1 Account Registration

To use HeroBounce services, you must:

  • Create an account with accurate and complete information
  • Be at least 18 years of age or have parental consent
  • Maintain the security of your account credentials
  • Promptly notify us of any unauthorized access
  • Accept responsibility for all activities under your account

3.2 Acceptable Use Policy

You agree to use HeroBounce only for lawful purposes. You must NOT:

  • Use our service to validate email lists obtained without proper consent
  • Violate GDPR, CAN-SPAM, CASL, or other anti-spam regulations
  • Send unsolicited commercial emails (spam) to validated addresses
  • Scrape, harvest, or collect email addresses from our service
  • Resell or redistribute validation results without authorization
  • Attempt to reverse engineer or compromise our validation algorithms
  • Overload our systems with excessive API requests beyond your plan limits
  • Use our service to harm, harass, or defraud individuals

Important: HeroBounce is designed to help you maintain clean email lists from legitimate opt-in sources. Using our service to validate purchased lists or for spam campaigns violates these Terms and may result in immediate account termination.

3.3 Service Limitations

You acknowledge and accept that:

  • Email validation results are probabilistic, not guaranteed 100% accurate
  • Some email providers block validation attempts, affecting accuracy
  • Catch-all detection may produce uncertain results for some domains
  • Validation speed depends on email provider response times
  • We may rate-limit requests to protect infrastructure and maintain service quality
  • Service availability is subject to our SLA terms for your plan tier

3.4 Accuracy Metrics and Performance Claims

Regarding accuracy percentages and performance metrics displayed on our website:

  • All accuracy percentages (e.g., "95%+", "99.5%") are performance targets and historical averages, not guarantees for any specific validation or batch of validations
  • Accuracy rates are measured against our internal test datasets and may vary based on the specific domains, email providers, and email patterns in your list
  • "Catch-all accuracy" refers to our ability to identify catch-all domains and provide confidence scores, not a guarantee that individual emails within catch-all domains are deliverable
  • Actual results may vary significantly based on factors outside our control, including but not limited to: email provider policies, temporary server issues, greylisting, rate limiting by receiving servers, and changes to email infrastructure
  • We do not guarantee any specific bounce rate, deliverability rate, or inbox placement rate for emails you send after validation
  • Performance metrics on marketing materials represent best-case scenarios under optimal conditions

Important: Email validation is inherently probabilistic. No email validation service can guarantee 100% accuracy due to the dynamic nature of email systems. You should always expect some margin of error and plan your email campaigns accordingly.

4. Privacy and Data Processing

When accessing certain content or services requires the provision of personal data, Users guarantee its truthfulness, accuracy, authenticity, and validity. The company will process such data automatically, as appropriate, under the terms indicated in the Privacy Policy section.

We process email addresses you submit for validation solely for the purpose of providing our service. We do not use validated email addresses for marketing purposes or share them with third parties, except as required by law or outlined in our Privacy Policy.

5. Subscription Plans and Billing

5.1 Free Plan

  • New users receive 100 free validation credits every month, resetting on their signup date
  • No payment method is required to start the trial
  • Email verification is required to activate your trial
  • Trial credits do not roll over to paid plans
  • After the trial ends, you must upgrade to a paid plan to continue using the service

5.2 Paid Plans

  • Subscription fees are charged monthly or annually based on your selected billing cycle
  • All fees are exclusive of applicable taxes, which will be added at checkout
  • Credits reset monthly and do not roll over to the next billing period
  • Validations are limited to your plan's monthly credit allocation - upgrade to increase your limit
  • Payment is processed securely through Stripe

5.3 Refunds and Cancellations

  • You may cancel your subscription at any time from your account dashboard
  • Cancellations take effect at the end of your current billing period
  • No refunds are provided for partial months or unused credits
  • Refunds for technical issues (e.g., service outages, billing errors) are handled on a case-by-case basis
  • We reserve the right to refuse refunds for violations of these Terms

Accuracy-Related Refund Policy:

  • Refunds are not provided based on claims that validation accuracy did not meet expectations or marketing percentages
  • As stated in Section 3.4, all accuracy metrics are performance targets, not guarantees
  • You acknowledge that email validation results are probabilistic and actual accuracy may vary
  • By using the service, you accept that some margin of error is inherent to email validation technology
  • We encourage you to use the free plan to evaluate whether the service meets your needs before subscribing

5.4 Plan Changes

You may upgrade or downgrade your plan at any time. Upgrades take effect immediately with prorated billing. Downgrades take effect at the start of your next billing cycle.

6. Industrial and Intellectual Property

The User acknowledges and accepts that all content displayed on the Website, and in particular, designs, texts, images, logos, icons, buttons, software, trade names, trademarks (including "HeroBounce"), or any other signs susceptible to industrial and/or commercial use, are subject to Intellectual Property rights and are the exclusive property of HeroBounce and/or third parties.

Under no circumstances does access to the Website imply any type of waiver, transmission, license, or total or partial assignment of said rights, unless expressly established otherwise.

You retain ownership of email addresses and data you submit for validation. We claim no ownership rights to your data.

7. Obligations and Responsibilities of the Website User

The User agrees to make appropriate and lawful use of the Website and, in particular, to:

  • Comply with applicable legislation, including GDPR, CAN-SPAM, and CASL
  • Respect morality, good customs, and public order
  • Provide truthful information when completing forms and keep it updated
  • Only validate email lists from legitimate, opt-in sources
  • Use validation results ethically and in compliance with privacy laws

In addition, the User must refrain from, among others:

  • Unauthorized or fraudulent use of the Website and/or its contents
  • Accessing or attempting to access restricted resources without required conditions
  • Causing damage to physical or logical systems of the Website or third parties
  • Introducing or spreading computer viruses or other harmful systems
  • Reproducing, copying, distributing, transforming, or modifying contents without authorization
  • Attempting to decipher, decompile, or reverse engineer our validation algorithms
  • Using automated tools to create multiple accounts or abuse trial credits
  • Sharing API keys with unauthorized third parties

8. Limitation of Liability

Continuous access, correct viewing, downloading, or use of the elements and information contained on the website is not guaranteed if impeded by factors beyond our control. The service may be interrupted if use of the Website is contrary to these Terms.

HeroBounce is not responsible for:

  • Damages arising from incorrect or inaccurate validation results
  • Bounced emails or delivery failures after validation
  • Third-party email provider policies or changes
  • Loss of data due to user error or account termination
  • Service interruptions due to maintenance, updates, or force majeure
  • Consequences of misusing validation results for spam or illegal activities

Our total liability for any claim arising from your use of HeroBounce is limited to the amount you paid us in the 12 months prior to the claim.

9. API Usage Terms

9.1 API Access

  • API keys are tied to your account and must be kept confidential
  • You are responsible for all API activity under your keys
  • API rate limits are enforced based on your plan tier
  • Exceeding rate limits may result in temporary throttling or additional charges

9.2 Webhooks

Webhook endpoints must use HTTPS and respond within 30 seconds. Failed webhook deliveries will be retried up to 3 times with exponential backoff.

10. Hyperlinks

The User undertakes not to reproduce the Website or any of its contents, not even through a hyperlink, unless expressly authorized in writing by HeroBounce.

The Website may include links to third-party websites or services. We are not responsible for the content, privacy practices, or availability of external sites.

11. Data Protection

To use our Services, you may provide certain personal data. HeroBounce will automatically process this data in compliance with the GDPR, LOPDGDD, and LSSI. See our Privacy Policy for details.

By using HeroBounce, you represent and warrant that you have the legal right to submit email addresses for validation and that you will use validation results in compliance with all applicable privacy and anti-spam laws.

12. Cookies

We reserve the right to use cookies on the Website to recognize you as a frequent user and personalize your experience. Please consult your browser's instructions for managing cookies. See our Cookie Policy for more information.

13. Disclaimer of Warranties

The content and services offered on the Website are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We make no warranty regarding:

  • 100% accuracy of validation results
  • Uninterrupted or error-free service
  • Compatibility with all systems and browsers
  • Future email deliverability of validated addresses
  • Merchantability or fitness for a particular purpose

14. Account Termination

We reserve the right to suspend or terminate your account immediately if:

  • You violate these Terms of Service
  • Your account is used for spam or illegal activities
  • Payment fails or chargebacks occur
  • We detect fraudulent or abusive behavior
  • You provide false information during registration

Upon termination, access to your account and validation data will be revoked. Outstanding charges remain due.

15. Force Majeure

We shall not be liable in the event of an inability to provide service due to prolonged interruptions in power supply, telecommunications lines, internet outages, DDoS attacks, natural disasters, strikes, rebellion, floods, acts or omissions of government authorities, and other force majeure events beyond our reasonable control.

16. Changes to Terms

HeroBounce reserves the right to modify these Terms at any time. We will notify users of material changes via:

  • Email notification to registered users
  • Prominent notice on the website
  • Update to the "Last updated" date above

Continued use of HeroBounce after changes constitutes acceptance of the modified Terms.

17. Dispute Resolution, Applicable Law and Jurisdiction

These Terms, as well as the use of the Website and Services, shall be governed by Spanish law in compliance with GDPR and LOPDGDD.

For the resolution of any dispute arising from or related to these Terms or the use of HeroBounce, both parties agree to first attempt to resolve the matter through good-faith negotiations.

If a resolution cannot be reached, the parties shall submit to the Courts and Tribunals of the registered office of HeroBounce, expressly waiving any other jurisdiction that may correspond to them.
